LEGAL INFORMATION
Terms of Service
Effective 14 September 2026 · Version 2026-09-14
Terms for using Avkash’s free pilot and managing an organisation workspace.
Operator and agreement
These Terms govern use of Avkash, operated by Gayatri Joshi, 1923, Sadashiv Peth, Pune - 411030, Maharashtra, India. Contact support@avkash.co for support or contractual correspondence.
The customer is the organisation or person agreeing to use the service. An administrator acting for an organisation must be authorised to do so. Individual members must follow their organisation’s authorised instructions and these usage rules. A separately agreed written customer contract takes priority over conflicting provisions of these Terms.
The service and free pilot
Avkash helps organisations manage leave, balances, holidays and work locations. Features and availability may evolve during the pilot. Examples and illustrative screens are not promises of every future feature or integration.
The pilot is free. These Terms do not authorise charges or automatic enrolment into a paid subscription. Any future paid service will require pricing and payment terms to be presented and agreed separately. There are no subscription payments to refund during the free pilot.
We aim to provide a useful and reliable service, but the pilot does not include a guaranteed uptime, support response time or service-level agreement unless separately agreed in writing.
Customer responsibilities
The organisation is responsible for the accuracy of employee data, lawful collection and instructions, notices to employees, access permissions, leave rules and decisions. Avkash is an administrative tool and does not provide employment, payroll, tax or legal advice. Review configurations and outputs for your organisation’s needs and applicable employment laws.
Protect your Google account and devices, grant access only to authorised people, keep administrator contacts current, and promptly report suspected misuse. The organisation should keep records and exports it needs for its own retention obligations.
Do not upload unlawful data, unnecessary sensitive information or material you have no right to share. Do not attempt to access another organisation, bypass controls, disrupt the service, distribute malicious code or use Avkash for unlawful activity.
Your data and our software
You and your organisation retain your rights in the information you provide. You permit us to host, process, transmit and use it only as needed to provide, support and secure the service, follow your instructions or meet legal obligations, as described in the Privacy Policy and applicable data-processing terms.
Avkash and its software, branding and other original materials remain the property of their respective owners. We give authorised users permission to use the service for its intended purpose while access is available. Feedback may be used to improve the service without an obligation to pay for it; this does not give us ownership of your employee records.
Integrations and support
Enabling an integration instructs Avkash to share the selected information with that service. You are responsible for the connected account, channel permissions and provider terms. Third-party interruptions or changes can affect integrations. Disconnecting does not necessarily remove copies already created in your connected accounts.
Authorised support and infrastructure operators may access data as reasonably needed to support, maintain and secure Avkash. In-app support sessions record the operator and actions. Report problems to support@avkash.co.
Ending access and exporting data
An authorised administrator may request organisation closure and an export by contacting support@avkash.co. Exports are provided in Excel format by email to a verified authorised administrator. We will confirm the scope and effective closure date. Your organisation should obtain any records it needs before deletion.
We may suspend access where reasonably necessary for security, unlawful use, a material breach or a legal requirement. We may also change or discontinue the pilot. Where practicable we will give advance notice and a reasonable opportunity to export data; urgent security or legal circumstances may require immediate action.
The Privacy Policy describes our 30-day offboarding deletion target, operator-assisted process, backup limitations and legal-retention exceptions. Customer-controlled copies remain your responsibility. Clauses needed to resolve outstanding matters, including data handling, ownership and disputes, survive termination.
Disclaimers and responsibility
To the extent permitted by applicable law, the pilot is provided as available, without warranties that it will be uninterrupted, error-free or suitable for every employment-policy requirement. This does not limit rights or obligations that cannot lawfully be excluded.
To the extent permitted by law, neither party is liable to the other for indirect or consequential losses arising from use of the service. This exclusion does not apply to fraud, deliberate misconduct or liability that cannot be excluded by law. Nothing in these Terms removes applicable duties concerning personal data.
Law, disputes and changes
These Terms are governed by Indian law. Subject to mandatory applicable law, courts in Pune, Maharashtra, India have jurisdiction over disputes. Please contact support@avkash.co first so we can try to resolve concerns. This choice does not override non-waivable rights or obligations applicable to international customers or individuals.
We may revise these Terms as the service changes. Material changes will be communicated where required, and additional acceptance will be requested where legally necessary. A new version does not retrospectively authorise a new use of your personal data. If you cannot accept revised terms, contact us to arrange closure and export.
